By accessing our website, submitting forms, requesting estimates, applying for financing, signing electronically, enrolling in subscriptions, or using our services, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, please do not use our website or services.

1. Use of Website

You agree to use our website only for lawful purposes and in a manner that does not infringe the rights of others or restrict their use of the site.

3. Estimates & Proposals

  • Pricing may change due to site conditions, material availability, labor costs, or scope changes
     
  • Estimates do not constitute a contract until a written agreement is signed by both parties
     

4. Contracts, Deposits & Payments

  • A signed contract may be required before work begins
     
  • Deposits, progress payments, and final payments will be outlined in the project agreement
     
  • Deposits may be non-refundable, particularly for custom materials, permits, or scheduling
     
  • Failure to make payments as agreed may result in project suspension or termination
     

Client remains responsible for all amounts due under the agreement.

5. Financing & Payment Plans

5.1 Financing Availability

Cup Lifestyles Inc. may offer or facilitate financing options through third-party lenders. Financing approval:

  • Is subject to lender review and creditworthiness
     
  • Is not guaranteed
     
  • Is governed by the lender’s independent terms and agreements
     

Cup Lifestyles Inc. is not a lender unless expressly stated in writing.

5.2 Third-Party Financing

  • Cup Lifestyles does not control financing approval decisions, interest rates, or repayment terms
     
  • Financing agreements are separate from service contracts
     
  • Any disputes related to financing must be resolved directly with the lender
     

5.3 Financing Defaults

Failure to meet financing obligations may result in:

  • Project delays or suspension
     
  • Additional fees as permitted by law
     
  • Collection actions
     

6. Electronic Records & Signatures

By submitting forms or signing electronically, you:

  • Consent to electronic records and signatures
     
  • Acknowledge electronic signatures have the same legal effect as handwritten signatures
     
  • Confirm all information provided is accurate and complete
     

7. Client Responsibilities

You agree to:

  • Provide accurate and truthful information
     
  • Ensure access to the property during scheduled services
     
  • Obtain required approvals (HOA, permits, inspections) unless otherwise agreed
     
  • Promptly notify us of changes affecting the project
     

Delays caused by client inaction or misinformation may result in cost or schedule adjustments.

8. Changes to Scope of Work

Any changes to design, materials, or scope must be approved in writing.
Additional costs or timeline extensions may apply.

9. Intellectual Property

All website content, including text, graphics, logos, designs, and media, is the property of Cup Lifestyles Inc. and protected by intellectual property laws.

Unauthorized use is strictly prohibited.

10. Warranties & Disclaimers

10.1 Limited Workmanship Warranty

Cup Lifestyles Inc. may provide a limited workmanship warranty for certain services. Warranty details, duration, and exclusions will be stated in the written contract or invoice.

Coverage is subject to:

  • Normal use and maintenance
     
  • Compliance with contract terms
     

10.2 Manufacturer Warranties

Materials, fixtures, cabinets, appliances, or equipment may be covered solely by manufacturer warranties.
Cup Lifestyles Inc. does not extend, modify, or guarantee manufacturer warranties.

10.3 Warranty Exclusions

Warranties do not cover:

  • Misuse, neglect, abuse, or unauthorized modifications
     
  • Normal wear and tear
     
  • Structural or pre-existing issues outside the agreed scope
     
  • Acts of God (floods, storms, fire, earthquakes, etc.)
     

10.4 Warranty Claims

Warranty claims must:

  • Be submitted in writing
     
  • Include proof of service
     
  • Be reported within the applicable warranty period
     

Cup Lifestyles Inc. reserves the right to inspect and determine eligibility.

11. Subscription, Membership & Maintenance Services

11.1 Subscription Plans

We may offer subscription-based services, including:

  • Maintenance plans
     
  • Service memberships
     
  • Periodic inspections or priority scheduling
     

Details will be disclosed at enrollment.

11.2 Billing & Auto-Renewal

  • Subscriptions may be billed monthly, quarterly, or annually
     
  • Plans may automatically renew unless canceled
     
  • Client authorizes recurring billing using the selected payment method
     

11.3 Cancellation

  • Cancellations must be submitted in writing or via the designated portal
     
  • Cancellations take effect at the end of the current billing period
     
  • No retroactive refunds unless required by law
     

11.4 Service Modifications

Cup Lifestyles Inc. may modify, replace, or discontinue subscription services with reasonable notice.

12. Refund Policy

  • Deposits and custom materials are generally non-refundable
     
  • Refund eligibility varies by service type and contract terms
     
  • Subscription fees are non-refundable for unused time unless required by law
     

13. Limitation of Liability

To the fullest extent permitted by law:

  • Cup Lifestyles Inc. shall not be liable for indirect, incidental, consequential, or punitive damages
     
  • Total liability shall not exceed the amount paid for the specific service giving rise to the claim
